1. INTRODUCTION

Welcome to Accra Hype.

These Terms of Use (“Terms”) govern your access to and use of:

  • www.accrahype.com;

  • the Accra Hype Facebook page;

  • the Accra Hype Instagram account;

  • the Accra Hype TikTok account;

  • the Accra Hype X account;

  • the Accra Hype Snapchat account;

  • the Accra Hype YouTube channel;

  • any other official Accra Hype website, social-media account, digital channel, application, page or platform that we operate or designate as official; and

  • all content, features, services and functionality made available through those platforms.

All of the above are collectively referred to as the “Platforms”.

These Terms constitute a legally binding agreement between you and:

In these Terms, “Accra Hype”, “we”, “us” and “our” refer to the above business/entity operating the Accra Hype brand.

“You” and “your” refer to anyone who accesses, visits, views, follows, interacts with, submits content to, communicates with, advertises through, or otherwise uses any of the Platforms.

By accessing or using any Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Platforms.

2. ABOUT ACCRA HYPE

Accra Hype is a digital media, entertainment, culture and lifestyle platform.

Our content may include:

  • news and current affairs;

  • entertainment;

  • music;

  • celebrity and public-figure content;

  • interviews;

  • events;

  • lifestyle;

  • fashion and culture;

  • photographs;

  • videos;

  • social-media content;

  • commentary and opinion;

  • user-submitted material;

  • advertisements;

  • sponsored content;

  • branded content;

  • promotional campaigns; and

  • other digital media.

We may add, remove, modify, suspend or discontinue content, features, services or Platforms at any time.

3. ELIGIBILITY

You may use the Platforms only where you are legally permitted to do so.

If a particular service, competition, promotion or activity has an age requirement, you must satisfy that requirement.

Where you use the Platforms on behalf of a company, organisation or other entity, you confirm that you have authority to act on behalf of that entity.

4. ACCEPTABLE USE

You agree to use the Platforms lawfully and responsibly.

You must not:

  1. violate any applicable Ghanaian or other applicable law;

  2. impersonate Accra Hype or any employee, representative, contributor or other person;

  3. provide false or misleading information;

  4. use the Platforms for fraud, scams or unlawful activities;

  5. interfere with the security or operation of the Platforms;

  6. attempt to gain unauthorised access to systems, accounts, databases or networks;

  7. introduce malware, viruses, malicious code or harmful material;

  8. conduct unauthorised scraping, crawling, harvesting or automated extraction of content;

  9. use bots or automated systems in a manner that adversely affects the Platforms;

  10. harass, threaten, stalk, intimidate or abuse another person;

  11. publish unlawful, defamatory, fraudulent, obscene or malicious material;

  12. infringe another person's intellectual-property rights;

  13. publish another person's confidential or private information without lawful authority;

  14. distribute spam;

  15. manipulate competitions, giveaways, engagement metrics or other promotional activities;

  16. interfere with another user's use of the Platforms;

  17. attempt to bypass security measures;

  18. use our branding or content in a manner suggesting false affiliation or endorsement; or

  19. otherwise misuse the Platforms.

We reserve the right to restrict, suspend or terminate access where we reasonably believe these Terms have been violated.

5. INTELLECTUAL PROPERTY

All intellectual property appearing on the Platforms may belong to Accra Hype or to third parties who have authorised us to use it.

This may include:

  • names;

  • logos;

  • trademarks;

  • articles;

  • photographs;

  • videos;

  • graphics;

  • designs;

  • layouts;

  • audio;

  • music;

  • captions;

  • compilations;

  • databases;

  • software;

  • original editorial material;

  • promotional material; and

  • other creative works.

Nothing in these Terms transfers ownership of Accra Hype intellectual property to you.

You may access and use our content for lawful personal and informational purposes and may use native sharing functions provided by social-media platforms.

You must not, without permission:

  • reproduce substantial portions of our content;

  • republish complete articles;

  • commercially exploit our content;

  • sell or licence our content;

  • remove attribution or copyright notices;

  • modify our content in a misleading manner;

  • create derivative commercial works;

  • present our work as your own; or

  • use Accra Hype branding to imply an unauthorised relationship.

Our Copyright Policy forms part of these Terms.

6. USER-GENERATED CONTENT

Users may have opportunities to submit:

  • photographs;

  • videos;

  • stories;

  • news tips;

  • comments;

  • reviews;

  • messages;

  • interviews;

  • opinions;

  • event information;

  • documents; or

  • other materials.

Collectively, this is “User Content”.

You remain responsible for User Content you submit.

By submitting User Content, you represent and warrant that:

  1. you own the content or have permission to submit it;

  2. you have all necessary rights, licences and permissions;

  3. the content does not infringe another person's rights;

  4. the content does not unlawfully disclose private information;

  5. the content is not knowingly false or fraudulent;

  6. where required, you have obtained appropriate consent from identifiable individuals appearing in the material; and

  7. your submission does not breach a contractual or legal obligation.

Subject to applicable law, you grant Accra Hype a non-exclusive, worldwide, royalty-free licence to reproduce, publish, display, distribute, communicate, edit, adapt, format and otherwise use the User Content for the purposes of operating, developing, promoting and distributing Accra Hype content across our Platforms.

This licence does not transfer ownership of your copyright to Accra Hype.

7. USER CONTENT MODERATION

We may review, moderate, edit, restrict, refuse or remove User Content at our discretion where we reasonably consider that the content:

  • violates these Terms;

  • violates applicable law;

  • infringes another person's rights;

  • is harmful or abusive;

  • is misleading;

  • creates a security risk;

  • constitutes spam;

  • is commercially inappropriate; or

  • may expose Accra Hype to legal or reputational risk.

We are not required to publish every submission.

8. COMMENTS AND SOCIAL-MEDIA INTERACTION

Where comments, replies, live chats or community features are available, users must behave respectfully.

We may remove comments or restrict accounts for:

  • harassment;

  • threats;

  • hate speech;

  • discrimination;

  • defamation;

  • impersonation;

  • spam;

  • fraud;

  • unlawful content;

  • doxxing or privacy violations;

  • malicious links;

  • repeated disruption; or

  • other inappropriate conduct.

Blocking or restricting an account does not necessarily mean that Accra Hype agrees with or disagrees with every statement made by that user.

9. EDITORIAL CONTENT

Accra Hype may publish information obtained from:

  • journalists;

  • contributors;

  • public records;

  • interviews;

  • press releases;

  • public statements;

  • social-media posts;

  • third-party media;

  • event organisers;

  • public figures;

  • agencies; and

  • other sources.

We make reasonable efforts to publish responsible content but do not warrant that every item will always be completely accurate, current or error-free.

Editorial content may include reporting, commentary, opinion, satire, analysis and entertainment.

Publication of a statement does not necessarily mean that Accra Hype independently endorses every assertion made by a source.

Where appropriate, we may correct or update published material.

10. USER TIPS AND NEWS SUBMISSIONS

If you voluntarily provide information, photographs, videos or tips to Accra Hype, you understand that we may assess the material for editorial purposes.

Submission does not guarantee publication.

We may contact you for clarification or additional information.

You must not knowingly submit fabricated information, manipulated material presented as genuine, stolen material or content obtained unlawfully.

11. ADVERTISING AND SPONSORED CONTENT

Accra Hype offers advertising, promotional and sponsored-content opportunities.

These may include:

  • sponsored articles;

  • sponsored social-media posts;

  • branded videos;

  • influencer or creator campaigns;

  • event promotion;

  • product promotion;

  • brand features;

  • interviews;

  • campaign partnerships;

  • display advertising;

  • social-media advertising;

  • promotional competitions; and

  • other agreed advertising services.

Advertising and sponsorship arrangements may be subject to separate written agreements, invoices, proposals, media kits, campaign briefs or insertion orders.

Where such a separate agreement exists, its specific commercial terms will govern the relevant advertising arrangement.

Accra Hype reserves the right to reject, modify or remove advertising that we reasonably consider unlawful, misleading, offensive, unsafe or inconsistent with our editorial or commercial standards.

Advertisers are responsible for ensuring that their claims, products, services and advertising materials comply with applicable law.

12. NO WEBSITE PAYMENT PROCESSING

Accra Hype does not currently accept payments directly through the website.

Where an advertiser or client purchases advertising or sponsored services, payment arrangements may be agreed separately through an invoice, quotation, contract, purchase order, bank transfer, mobile-money arrangement or another payment method communicated directly by Accra Hype.

Users should not send payment information through website comment fields, social-media comments or unofficial accounts.

Accra Hype is not responsible for payments made to fraudulent persons impersonating Accra Hype.

13. THIRD-PARTY PLATFORMS

Our Platforms may contain links, embeds or integrations provided by third parties.

These may include:

  • Facebook;

  • Instagram;

  • TikTok;

  • X;

  • Snapchat;

  • YouTube;

  • Google;

  • analytics providers;

  • advertising providers;

  • hosting providers; and

  • other third-party services.

Third-party services operate under their own terms and privacy policies.

Accra Hype does not control third-party platforms and is not responsible for their availability, security, content, policies or conduct.

Accra Hype cannot guarantee continued availability of any particular post, account, video, story, livestream or other content.

15. THIRD-PARTY PRODUCTS AND SERVICES

Accra Hype may refer users to third-party products, services, events, businesses or websites.

Unless expressly stated otherwise, such references do not constitute a guarantee or warranty by Accra Hype.

Any transaction between you and a third party is primarily between you and that third party.

16. COMPETITIONS AND GIVEAWAYS

Accra Hype may conduct competitions, giveaways and promotions.

Each promotion may have additional rules covering:

  • eligibility;

  • entry requirements;

  • closing dates;

  • judging;

  • prizes;

  • winner selection;

  • verification;

  • disqualification;

  • publicity; and

  • prize collection.

Those rules will apply to the relevant promotion.

Accra Hype may disqualify entries involving fraud, manipulation, multiple unauthorised entries or other prohibited conduct.

17. PRIVACY

Your use of the Platforms may involve the collection and processing of personal information.

Our Privacy Policy explains how we collect, use, disclose, store and protect personal information.

Our Cookie Policy explains the use of cookies and similar technologies.

Both policies form part of these Terms.

18. SECURITY

We take reasonable measures to protect the Platforms and information within our control.

However, no internet transmission or information system can be guaranteed to be completely secure.

You should not send highly sensitive personal, financial or confidential information through public comments or unofficial social-media accounts.

You are responsible for maintaining the security of your own devices and accounts.

19. AVAILABILITY

We do not guarantee that the Platforms will always be:

  • available;

  • uninterrupted;

  • error-free;

  • secure;

  • current;

  • compatible with every device; or

  • free from harmful components.

We may temporarily suspend access for maintenance, security, technical, operational or business reasons.

20. DISCLAIMER

To the fullest extent permitted by Ghanaian law, the Platforms and their content are provided on an “as available” and “as is” basis.

We do not guarantee that:

  • all content is complete;

  • all information is current;

  • all content is error-free;

  • every link will work;

  • the Platforms will operate continuously;

  • third-party services will remain available; or

  • the Platforms will satisfy every particular purpose.

Nothing in these Terms excludes rights or protections that cannot lawfully be excluded.

21. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Accra Hype and its owners, directors, officers, employees, contractors, contributors, agents and affiliates will not be responsible for indirect, incidental, special or consequential loss arising from your use of the Platforms.

This includes, where legally permitted, loss resulting from:

  • reliance on published information;

  • third-party websites;

  • third-party services;

  • User Content;

  • temporary Platform interruption;

  • technical failures;

  • unauthorised access outside our reasonable control; or

  • other matters connected with use of the Platforms.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

22. INDEMNITY

To the fullest extent permitted by law, you agree to indemnify Accra Hype and its owners, directors, officers, employees, contractors, agents and contributors against claims, liabilities, losses, damages and reasonable costs arising from:

  • your breach of these Terms;

  • your unlawful use of the Platforms;

  • your User Content;

  • infringement of another person's rights; or

  • your violation of applicable law.

23. TERMINATION AND RESTRICTION

We may restrict, suspend or terminate access to the Platforms or specific features where reasonably necessary.

We may also remove User Content or restrict social-media interaction.

These actions may be taken where we believe there has been:

  • a breach of these Terms;

  • unlawful activity;

  • fraudulent activity;

  • security abuse;

  • infringement of rights; or

  • conduct that threatens the Platforms or other users.

24. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The revised Terms will be published on the website with a new “Last Updated” date.

Your continued use of the Platforms after the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by law.

25. GOVERNING LAW

These Terms are governed by the laws of the Republic of Ghana.

Subject to applicable law, disputes relating to these Terms or the Platforms shall fall within the jurisdiction of the appropriate courts of Ghana.

Nothing prevents either party from seeking urgent legal relief where appropriate.

26. SEVERABILITY

If any provision is determined to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect.

27. NO WAIVER

Failure by Accra Hype to enforce any provision immediately does not constitute a waiver of our right to enforce that provision later.

28. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Cookie Policy, Copyright Policy, promotion rules and any separate commercial agreements, constitute the applicable agreement governing use of the Platforms.
